📋 Kullanım Şartları

1. Parties and Scope

These Terms of Use ("Terms") apply to dealer, pharmacy, and medical institution accounts ("Member") using the B2B platform ("Platform") operated by ERC Bio Teknoloji Medikal Sağlık Ürünleri Tic. Ltd. Şti. ("ERC Bio Teknoloji"). A Member who registers on the Platform or uses the Platform in any way is deemed to have accepted these Terms.

2. Membership and Account Use

• The Platform is open only to approved dealer/pharmacy/medical institution accounts; membership applications are reviewed and approved by ERC Bio Teknoloji.
• The Member is responsible for the confidentiality of their account credentials (username, password) and for all transactions carried out through their account.
• Accounts opened with false, misleading, or incomplete information may be suspended or closed.
• ERC Bio Teknoloji reserves the right to suspend a Member's access to the Platform, with prior notice, in justified circumstances (misuse, payment violation, etc.).

3. Product Information, Pricing, and Orders

• Product images, descriptions, and stock information on the Platform are provided for informational purposes; packaging and label information may vary from product to product.
• Under the B2B business model, price information is shown only to logged-in members; price requests are forwarded to the relevant sales team via WhatsApp. Prices displayed or communicated through the Platform do not constitute a binding offer until the order is confirmed.
• An order becomes final once confirmed by ERC Bio Teknoloji; in the event of insufficient stock, an order may be partially or fully cancelled, and the Member will be notified.
• Documents such as certificates, CE certificates, and user manuals are made available for download only to logged-in members.

4. Payment and Invoicing

Payment terms (cash, deferred payment, wire transfer/EFT, etc.) are determined by the separate commercial agreement reached between ERC Bio Teknoloji and the Member. Invoices are issued electronically or in print in accordance with applicable legislation (Turkish Tax Procedure Law), based on the Member's information on record in the Platform.

5. Delivery, Returns, and Exchanges

• The delivery time and method are communicated to the Member upon order confirmation; shipment tracking may be carried out through the Platform.
• Due to the nature of medical products, returns may not be accepted for products whose packaging has been opened, whose hygiene seal has been broken, or whose remaining shelf life has been reduced; this is assessed according to applicable legislation and the type of product.
• Notifications of damage occurring during transport, or of incorrect/incomplete delivery, must be submitted to ERC Bio Teknoloji within a reasonable period following delivery.

6. Intellectual Property

All trademarks, logos, images, text, and software elements on the Platform belong to ERC Bio Teknoloji or its authorized licensors. The Member may not reproduce, distribute, or use this content for commercial purposes without the prior written consent of ERC Bio Teknoloji.

7. Limitation of Liability

ERC Bio Teknoloji does not guarantee that the Platform will operate uninterrupted or error-free, and cannot be held liable for interruptions caused by maintenance, updates, or force majeure. ERC Bio Teknoloji's total liability under these Terms is limited to the value of the relevant order; to the extent permitted by applicable law, no liability is accepted for indirect damages (loss of profit, loss of business, etc.).

8. Changes

ERC Bio Teknoloji may update these Terms when necessary. Significant changes will be communicated through the Platform or by email; the current version can always be accessed on this page. Continued use of the Platform after a change constitutes acceptance of the updated Terms.

9. Dispute Resolution

Turkish law applies to disputes arising from these Terms; the Courts and Enforcement Offices of Istanbul (Anatolian side) have jurisdiction.
